Developer, province fight over N.S. island

MAHONE BAY, N.S. — A small island off the coast of Mahone Bay is the centre of a dispute between an Austrian hotel developer and the Nova Scotia government.
Bernt Kuhlmann says he paid more than $300,000 for Spectacle Island two years ago.

But the Department of Natural Resources says the island still belongs to the government.
"Our records show that it's ungranted Crown land," says Susan Mader-Zinck, a department spokesperson.
Kuhlmann will have to prove the island has been occupied for at least 40 years in order to get title to the land.
"What it comes down to is when there's any real estate transaction, there's a need for you to ensure title to that land before you go through with a purchase or sale," says Mader-Zinck.
Disputes aren't uncommon when it comes to ungranted Crown land, she adds. There are several going at any one time.
